On The Commons is a weekly radio show dedicated to discussing the many issues surrounding mandatory homeowner associations, the fastest growing form of residential housing in the nation.
In communal living arrangements the membership relies on participation from everyone. In common ownership developments that participation is in the form of an assessment. While there is no question that those who live in associations should pay their fair share, is there a responsibility on the part of the association to make a few direct inquiries to a delinquent member before bringing out the big guns? And should associations be allowed to refuse payments tendered? Is that fair to the rest of the owners?

Marian, a Houston, Texas attorney was in the spotlight several months ago when she came to the rescue of an 83 year old widow who, along with her cat, had been tossed out of her home by her homeowners association. With all the negative publicity that case generated you'd think associations and their expert advisors would have learned a lesson. Marion again has come to the rescue of another homeowner who was also facing foreclosure.
