On The Commons is a weekly radio show dedicated to discussing the many issues surrounding mandatory homeowner associations, the fastest growing form of residential housing in the nation.
Most, if not all, states require that home buyers be provided with disclosures of the homeowner association, if any, in control of the development. The items to be provided to housing consumers vary from state to state but generally include a copy of the governing documents. As a rule the seller is responsible for providing this information. It was thought at one point that if consumers knew what to expect and were properly educated regarding controlled living, there would be fewer problems. However that does not seem to be the answer, and new homeowners still find themselves in for a few nasty surprises. And so the finger pointing continues and the debate still centers on who is to blame for all of these problems.
