Obama Administration Moves to Suspend Court Decision Blocking Indefinite Detention of U.S. Citizens

The Obama Administration is already preparing a bid to suspend this week's decision by a federal judge that blocked enforcement of a law permitting indefinite military detention of U.S. citizens. The law would permit the government to place U.S. citizens in military detention indefinitely, without charge or trial, on mere suspicion of support for Al Qaeda or other groups that the Executive Branch deems to be "associated" with it. On Wednesday, Judge Katherine Forrest of the U.S. District Court for the Southern District of New York blocked the government from enforcing the controversial provision, which was contained in the 2012 National Defense Authorization Act and signed into law by President Obama late last year. She denied the Justice Department's request to stay her injunction on Friday. An attorney for the plaintiffs says the Administration plans to request an emergency stay of the judge's ruling from the Second Circuit Court of Appeals first thing Monday morning. Several prominent public figures brought the lawsuit, including Pulitzer-Prize winning journalist Chris Hedges, renowned linguist and political critic Noam Chomsky, and America's best-known whistle-blower and lifelong peace activist, Daniel Ellsberg, who released the top-secret Pentagon Papers in 1971. With Carl Mayer, an attorney for the plaintiffs and director of the Mayer Law Group.

It Ain't Over: New Evidence of CIA Waterboarding Emerges on Heels of Investigation Closure (Sept. 8, 2012)

Days after Attorney General Holder announced the closure of the last two criminal investigations of the torture and murder of detainees in CIA custody during the Bush Administration, Human Rights Watch released a new report contradicting official accounts of the extent of CIA waterboarding in Afghanistan 9 years ago. The report, based on documents and interviews collected in Libya after the fall of Col. Muammar Gaddafi, documents the torture of Libyan detainees in CIA custody, as well as their transfer to Libya, where they were further abused by Gaddafi's government. The former detainees, some of whom now hold leadership positions in the new Libyan government, said they were captured in Afghanistan while training to overthrow the Gaddafi regime. The failure of the Obama Administration to prosecute government officials implicated in torture opens the door to their prosecution elsewhere.
