On The Commons is a weekly radio show dedicated to discussing the many issues surrounding mandatory homeowner associations, the fastest growing form of residential housing in the nation.

We are told that 50 million Americans live in dwelling units controlled by homeowners associations, be they condos, co-ops or single family homes. Almost all new housing built today comes complete with a list of restrictions and a Board of Directors with seemingly unlimited power to enforce those restrictions. It is generally accepted that board members are completely insulated and immune from being personally held responsible for their actions.

On The Commons with me this week is Stephen Marcus. Steve is the principal partner in the Massachusetts based law firm of Marcus, Errico, Emmer and Brooks and is past president of the New England Chapter of the Community Association Institute. Steve's article, "Board Members may be Sued Individually", printed in the August edition of Condo Management Magazine, suggests that board members may not be as untouchable as we have been led to believe.
